The Difference Between a $500 and a $1,500 TCPA Violation
Under the Telephone Consumer Protection Act, consumers who receive illegal calls or texts may be entitled to damages. The amount depends on the nature of the violation. Standard violations carry a penalty of $500 per message or call. But if the violation was willful or knowing, a court can award up to $1,500 per violation, which is triple the standard amount.
So what is the difference, and how is it determined?
Standard Violations: $500 Per Message or Call
A standard TCPA violation occurs when a company contacts you using automated technology without your prior express written consent. This is the baseline. If a company sent you a single marketing text without permission, that text is worth $500 in statutory damages.
It does not matter whether the company intended to break the law. The TCPA is a strict liability statute for many violation types, meaning that the act itself is enough. If they sent it and you did not consent, that is a violation.
Willful or Knowing Violations: Up to $1,500
The treble damages provision kicks in when the violator knew what they were doing, or should have known. Courts look at factors like:
- The company continued to contact you after you asked them to stop
- The company had been previously sued or warned about TCPA violations
- Internal records show the company was aware its practices might violate the law
- The company used aggressive tactics like spoofing caller IDs or rotating phone numbers to avoid blocks
- The company had no TCPA compliance program in place despite conducting large-scale automated outreach
If a company kept texting you after you replied STOP, that is one of the strongest indicators of a willful violation. Each message sent after your opt-out could be worth up to $1,500.
How Courts Decide
The decision between $500 and $1,500 per violation is made by the judge or jury hearing the case. It is not automatic. Your legal team will present evidence showing the nature of the violation, and the court decides whether the treble damages multiplier applies.
In practice, many cases settle before reaching trial. Settlement amounts are negotiated based on the strength of the evidence, the number of violations, and the likelihood of a willful finding.
