About TCPA Claims
What is the TCPA?
The Telephone Consumer Protection Act is a federal law that restricts how companies can use automated technology to contact consumers by phone or text. It covers robocalls, autodialed texts, pre-recorded messages, and Do Not Call violations. See our TCPA Explained page for a full breakdown.
How much can I receive for a TCPA violation?
The TCPA provides for $500 per violation for standard violations, and up to $1,500 per violation if the violation was willful or knowing. If you received multiple illegal messages, each one may be counted separately.
What if I’m not sure whether my situation qualifies?
Submit it anyway. Our team reviews submissions at no charge and will tell you if we think you have a viable claim. We would rather review a borderline case than have you miss out on compensation you are entitled to.
Do I need to have a screenshot?
Screenshots are very helpful but not always required. If you received a robocall, a note of the date, time, and calling number may be sufficient to begin an evaluation. The more documentation you have, the stronger your claim.

Is there any cost to submit my information?
No. Submitting your information and having our team review it is completely free. There is no obligation and no credit card required.
How do your legal partners get paid?
Our legal partners work on a contingency fee basis. That means they are paid a percentage of any recovery — if there is no recovery, there is no fee. You will never be asked to pay out of pocket.
What percentage of my recovery goes to the attorneys?
Contingency fee percentages vary by case and will be specified in the representation agreement before you commit to anything. You will know the terms before signing.
About the Process
How long does the process take?
Timelines vary. Simple demand letter cases can resolve in a few weeks. More complex cases or litigation can take several months to a year or more. We will give you realistic expectations for your specific situation.
Will I have to go to court?
Most cases do not go to court. Many TCPA claims are resolved through demand letters or negotiated settlements. If litigation is necessary, our attorneys handle all of that on your behalf.
What happens after I submit my information?
Our legal team reviews your submission, typically within 1–3 business days. We will then contact you by phone or email with our assessment. If we believe you have a strong claim, we’ll discuss next steps.
Can I file a claim even if I only received one text?
Yes. A single illegal text message is a violation. While more violations can mean more potential recovery, we evaluate all submissions regardless of the number of messages.

Who will see my information?
Only Hammerhead Legal staff and our legal partners involved in reviewing and handling your claim. Your information is not shared with any third parties for marketing purposes.
What if I change my mind after submitting?
You are under no obligation after submitting your information. If you decide you do not want to pursue a claim, simply let us know and we will not move forward.
